1. Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you ("you" or the "Customer") and Hostoniq ("Hostoniq", "we", "us", or "our"). By ordering, accessing, or using our website or Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Description of Services
Hostoniq provides web hosting and related services, including domain registration, shared hosting, VPS, dedicated servers, email hosting, SSL certificates, and security products (collectively, the "Services"). Specific features and resources are described on the relevant product pages at the time of purchase.
3. Accounts & Eligibility
You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate, current, and complete information, to keep your account credentials confidential, and to be responsible for all activity under your account.
4. Fees, Billing & Renewals
- Prices are displayed at checkout in USD or IQD and are billed in advance on a recurring basis (e.g., monthly, annually) according to the plan you select.
- Services renew automatically at the end of each billing cycle unless cancelled before the renewal date. Renewal invoices are generated ahead of the due date.
- Accepted payment methods include ZainCash, Qi Card, and card payments processed by Stripe and other providers.
- You authorize us and our payment processors to charge your selected payment method for all applicable fees, taxes, and renewals.
- Late or failed payments may result in suspension or termination of the Services.
5. Refund & Cancellation Policy
30-day money-back guarantee on eligible shared hosting. If you are not satisfied with a new shared hosting plan, you may request a full refund within 30 days of your initial purchase.
- Non-refundable items: domain registrations and renewals, SSL certificates, dedicated servers, and administrative or setup fees are non-refundable once provisioned, because they involve third-party or one-time costs.
- VPS and dedicated services are provided on a best-effort basis and, unless stated otherwise, are non-refundable after activation.
- Renewals are non-refundable after the renewal date. Please cancel before your renewal date to avoid being charged.
- How to cancel: you can request cancellation at any time from your client area or by contacting support. Cancellation stops future renewals; it does not automatically refund the current term unless covered by the guarantee above.
- Refunds are issued to the original payment method within a reasonable period after approval.
- We reserve the right to deny refunds in cases of abuse, fraud, or violation of these Terms.
6. Acceptable Use Policy
You agree not to use the Services to host, transmit, or link to any content or activity that:
- Is illegal, infringing, defamatory, or violates the rights of others;
- Contains malware, phishing, spam, or is used for unsolicited bulk email;
- Involves child sexual abuse material, or promotes violence or terrorism;
- Attempts to gain unauthorized access to systems, or disrupts networks or other users;
- Consumes resources in a way that harms server stability or other customers ("fair use").
We may investigate violations and remove content or suspend accounts that breach this policy.
7. Backups & Data Responsibility
While we may keep periodic backups of our infrastructure, you are solely responsible for maintaining your own backups of your data. Hostoniq is not liable for any loss or corruption of data.
8. Domain Registrations
Domain registrations are subject to the policies of the relevant registry and ICANN, including applicable registration agreements. You are responsible for providing accurate registrant information and for renewing domains on time.
9. Service Availability
We strive to provide reliable, high-uptime Services but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party failures, or events beyond our control may affect availability. Any service credits, where offered, are as described in the applicable plan.
10. Suspension & Termination
We may suspend or terminate your Services, with or without notice, for non-payment, violation of these Terms, or activity that threatens the security or integrity of our systems. You may terminate at any time by cancelling your Services.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, Hostoniq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our total liability for any claim shall not exceed the amount you paid for the Services during the three (3) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Hostoniq and its affiliates from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Disputes shall be subject to the courts located in California, unless otherwise required by applicable law.
